Golf Smash Terms of Use

These terms are the agreement between you and us about using Golf Smash ("the game"). By installing or playing the game you agree to them. If you do not agree, please do not use the game.

Who we are

Golf Smash is made by Sean Heide ("we", "us"), an individual developer in British Columbia, Canada. Questions about these terms: support@playgolfsmash.com

Using the game

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on your own devices for your own non-commercial use. The game is licensed to you, not sold.

Please do not:

• copy, resell, rent or redistribute the game or its content;
• reverse engineer, decompile or modify the game, except where the law says you may;
• cheat, tamper with the game's files or saves, or use bots or tools that give an unfair advantage;
• use the game for anything unlawful.

Age

You must be at least 13 years old (or the minimum age in your country, if higher) to use the game.

Virtual items and currencies

The game has virtual items and currencies such as tokens and gems. They only exist inside the game. They have no cash value, cannot be exchanged for money or real-world goods, and cannot be sold or transferred to anyone else. In this version they are earned by playing and cannot be bought. We may change how they are earned or used, for example to keep the game balanced.

Your saves

Your progress is stored on your device. There is no account and no cloud save. If you delete the game, reset or lose your device, or the save is damaged, your progress may be lost, and we cannot restore it. We are not responsible for lost progress or data.

Changes to the game and these terms

The game is in testing. We may update, change or stop parts of the game at any time, for example to fix bugs, rebalance, or add or remove features, and we may reset test progress. We may update these terms too. The date at the top shows when they last changed. If a change is significant we will tell you in the game or on this site. If you keep playing after a change, you accept the updated terms.

Ending these terms

You can stop at any time by deleting the game. We may suspend or end your access if you break these terms. These terms end when you stop using the game, but the parts that are meant to continue (such as the disclaimers and limits below) do.

No warranty

We make the game for fun and try to keep it working, but it is provided "as is" and "as available". We do not promise it will be error-free, always available, or work on every device. To the extent the law allows, we give no warranties of any kind, express or implied.

Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost progress, lost data or lost profits arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid us for the game in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, and your legal rights as a consumer in your country are not affected.

Apple App Store

If you downloaded the game from the Apple App Store: these terms are between you and us, not Apple. Apple is not responsible for the game or its content, maintenance, support or warranty, or for claims about it. Apple's standard licensed application end user licence agreement also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Apple and its subsidiaries are third-party beneficiaries of that agreement and may enforce it against you. If these terms conflict with Apple's standard terms for App Store downloads, Apple's terms apply to that point.

Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to its conflict-of-law rules. If you are a consumer, you also keep any mandatory rights you have under the law of the country where you live.
